A Gentle Reminder

Please be informed that photography by itself is not a crime, especially one performed in public space. An exception is made if over the course of performing photography, the photographer…

Whoever, intending to insult the modesty of any person, utters any word, makes any sound or gesture, or exhibits any object, intending that such word or sound shall be heard, or that such gesture or object shall be seen by such person, or intrudes upon the privacy of such person, shall be punished with imprisonment for a term which may extend to five years, or with fine, or with both.

--Malaysian Penal Code, S. 509

That is to say, there shall be no upskirt and bedroom shots, or anything of that nature, even from public space.

On the other hand, intimidation, trespass, detinue, damage, battery, assault, and false imprisonment... are all crimes. In addition, my right to express myself, including through the art of street photography, is protected under Article 10(1)(a) of the Federal Constitution.

Thank you for your kind attention.

Yours faithfully,
Yet another annoyed photographer
